5120 - SCHOOL STUDENT ATTENDANCE ZONES AND INTERZONE TRANSFERS

 

Purpose

 

This policy provides a process for student assignment that promotes and supports other School Board policies, and the Board’s Strategic Plan System Initiatives. This policy minimizes overcrowded conditions, promotes, and maintains a diverse student enrollment consistent with Constitutional requirements, accommodates family choice to the maximum extent possible, and supports implementation of ePathways, educational pathways, to the maximum extent possible. Diversity includes socioeconomic status, gender, race/ethnicity, English Speakers of Other Languages (ESOL), and disability. The process includes four (4) major components, or tools, for accomplishing those goals:

  1. Geographical attendance zones based on residence Individual school zones region zones of two (2) or more schools.
     
  2. ePathways (educational pathways) Magnet Schools and Programs Virtual, Flexible Scheduling, and Blended School Options Programs of Emphasis.
     
  3. Student Out-of-Zone Transfers Annually defined options to increase choice employee transfers capacity transfers to minimize overcrowded conditions diversity incentives to encourage and maintain a diverse enrollment maximization transfers to make the most efficient use of available space and maximize family choice options.
     
  4. Class size assignments.

Definitions

  1. Administrative Assignment

    An administrative assignment is a unilateral assignment of a student from his/her zoned school or other regular school of attendance to another District school by the Superintendent or appropriate executive director, as the Superintendent’s designee, for reasons deemed to be in the best interest of the student, the school, or the School District.

     
  2. Capacity Transfer

    A voluntary transfer option that is permitted by Board policy to encourage the transfer of students between designated over-capacity schools and designated under-capacity schools.

     
  3. Class Size Assignment

    Administrative assignment of a student from the zoned school to another District school due to a grade level reaching maximum class size capacity.

     
  4. Diversity Incentive Transfer

    A voluntary transfer option that brings schools closer to the average percentage of students approved for free/reduced price meal benefits at the elementary, middle, and high school levels.

     
  5. Employee Transfer

    A voluntary transfer option for full-time District employees to transfer their child to a District school that has been specifically designated as an under-capacity school by the Superintendent.

     
  6. ePathways

    Educational pathways is customized learning that results in students being prepared for 21st century globally competitive work.

     
  7. FISH (Florida Inventory of School Houses) Capacity

    Data, inventory and numbering system used by the Florida Department of Education, Office of Educational Facilities, for buildings, rooms, and occupancy levels in public educational facilities (hereinafter referred to as “FISH”).

     
  8. Full-Time Site Based Employee Transfer

    A voluntary transfer option that allows a student to attend the school at which the student’s parent is a full-time site based employee.

     
  9. Geographical Attendance Zone

    Geographical area in which all resident students are assigned to a specific school or region school.

     
  10. Magnet Programs

    Board-approved programs at schools designed to address the interests and needs of students and to promote and maintain diversity consistent with Constitutional requirements. All students living more than two (2) miles from the school qualify for transportation.

     
  11. Magnet Schools

    Schools designed to address the interests and needs of students and to promote diversity consistent with Constitutional requirements. All students living more than two (2) miles from the school qualify for transportation.

     
  12. Maximization Transfer

    A voluntary transfer option that is permitted by Board policy to encourage the transfer of students between designated under-capacity schools to designated greater under-capacity schools in order to make the most efficient use of available space and maximize family choice options.

     
  13. Newly Enrolled Student

    For the purpose of this policy, the term “newly enrolled student” is defined as a student that has never been enrolled in the District or a student that has withdrawn and is returning to the District after one (1) academic year.

     
  14. Over-Capacity/Under-Capacity

    An over-capacity school has an enrollment that exceeds its program capacity; an under-capacity school has an enrollment less than its program capacity.

     
  15. Parent

    The term “parent” as herein used shall mean either or both parents of a student, any legal guardian of a student, any person in a parental relationship to a student, or any person exercising supervisory authority over a student in place of the parent, as defined by F.S. 1000.21(5).

     
  16. Preference Zone

    A specifically described geographical area surrounding a (region or magnet) school in which students residing in the preference zone have a placement preference in the student assignment process for that school.

     
  17. Program Capacity

    Actual capacity at a school adjusted by the Superintendent for factors (portables, Pre-K classrooms, VPK programs, Intensive Classes, Testing Labs, Computer Labs) not recognized or accounted for accurately by FISH. Program capacity includes FISH capacity modified by the Superintendent to account for class size, classroom program use, and scheduling.

     
  18. Program of Emphasis

    A structured study strand centered on a career pathway.

     
  19. Sibling

    Any brother and/or sister related by blood, adoption, marriage, or court appointed guardianship permanently residing at the same address.

     
  20. Sibling Link

    The practice of allowing a student to attend the same school/program with a sibling.

     
  21. Student Assignment

    A student assignment is an involuntary change in a student’s school of enrollment as authorized by this policy.

     
  22. Student Transfer

    A student transfer is a voluntary change in a student’s school of enrollment for reasons set forth herein.

     
  23. Seminole County Virtual School Options

    Virtual school provides flexible options to meet the demanding schedule of 21st century students. Students may enroll in District Virtual School (SCVS) full time. Virtual classes are available through ePathways (blending virtual with face-to-face courses) either at the zoned school during the school day in a virtual learning lab or outside of the school day.

Geographical Attendance Zones

  1. Establishment of Attendance Zones
     
    1. The Board shall establish attendance zones for each District school, and region, other than county-wide magnet schools. These attendance zones should reflect the diversity of the community and shall be described and posted on the District's website. Students shall attend the school(s) serving their residential zone or region zone unless otherwise permitted herein.
       
    2. Parents residing in a region will designate by rank order their preference for their student among the schools located within the region. Student assignment will be determined by random selection based on the following criteria: preference zone, full-time site-based employee, sibling placement, socioeconomic diversity, family preference, and capacity. The Superintendent will annually determine diversity goals to ensure a diverse student enrollment consistent with constitutional requirements. The Regions Choice/Student Assignment Process Logic Timeline is located at https://www.scps.k12.fl.us/district/departments/assignmentaccess/elementary-region-schools.stml and it will be updated as annually determined by the Superintendent.
       
    3. Region School Wait Pools
       
      1. Students who are not offered a position in their first requested region school are automatically entered into a waiting pool for that school. Waiting pools are organized according to the following criteria.
         
      2. On-time applicants not assigned to the region school are randomly placed in a waiting pool for that school for the remainder of the current school year.
         
      3. Region school applicants who are not placed in their region school of choice during the current school year are required to resubmit their region school application for the following school year.
         
      4. When positions become available, on-time waiting pool applicants will be offered positions prior to any late applicants to the extent practicable.
         
      5. Late applicants will be chosen from the waiting pool in order of the date and time their applications are received by the Student Assignment & Program Access Department.
    4. Transportation shall be provided to students in accordance with Florida statutes on an equitable, nondiscriminatory basis. The Superintendent has the authority to determine prioritized assignment goals.
  2. Revision of Attendance Zones and Preference Zones
     
    1. The Board may consider revisions to geographical attendance zones as defined in Policy 5120.01.
       
    2. The Superintendent may consider revisions to preference zones based upon new construction as long as the revision is contiguous with the currently established preference zone.

ePathways (Educational Pathways)

  1. Magnet Schools and Magnet Programs
     
    1. The Board is committed to maintaining and supporting magnet schools and programs. Magnet schools and magnet programs are offered for the purpose of providing students with the opportunity to attend school with students of diverse backgrounds, address the interests and needs of students, and increase enrollment at under-capacity schools. The Board has the authority to designate schools as magnet schools.
       
    2. The list of magnet schools and magnet programs approved by the Board is available on the District website at www.scps.us.
       
    3. Eligibility for Magnet Schools and Magnet Programs
       
      1. Parents who reside in Seminole County are eligible to submit applications for their students applying to kindergarten through grade twelve for the magnet schools and magnet programs listed on the District home page at www.scps.us.
         
      2. Acceptance into a magnet school/magnet program for students applying for grade ten and above is contingent upon an administrative review of their transcripts.
         
      3. A student will remain in a magnet school/magnet program for a minimum of one (1) year after acceptance unless the school/program determines that program requirements are not fulfilled. Once a student has enrolled in a magnet school/magnet program, the student may not re-enroll in the zoned school or transfer to another school until the student has completed the academic year. In each subsequent year, midyear exits are not permitted.
         
      4. Any out of zone student who exits a magnet program will return to his/her zoned school unless there is a Board approved transfer that allows the student to remain at the school where the magnet is located.
         
      5. Any student currently attending Hamilton, Idyllwilde, Midway, Pine Crest, or Wicklow Elementary Schools and Millennium, Milwee, Sanford, or South Seminole Middle Schools as a zoned magnet student who moves out of that geographic attendance zone and into another District geographic attendance zone may complete the out of zone magnet application and remain in the magnet program as an out of zone magnet student.
         
      6. Pending class size availability and the accommodation of a student schedule, siblings will be permitted to attend the same school, as practicable.
    4. Application Process
       
      1. By April of each school year, the Superintendent will publish the application time line for secondary and elementary magnet schools and magnet programs.
         
      2. Applications for magnet schools/magnet programs are available online at www.seminoleschoolchoiceapplication.us. Access to applications for magnet schools/programs is also available in the Student Assignment & Program Access Department.
    5. Selection Process
       
      1. Consistent with Constitutional requirements, students are selected for magnet schools and magnet programs according to the criteria in the magnet school/program selection table, as annually determined by the Superintendent. The magnet school/magnet program selection table is posted on the District website at https://www.scps.k12.fl.us/district/departments/assignmentaccess/magnet-schools.stml and available in print at the Student Assignment & Program Access Department.
         
      2. All applicants will receive an email (or letter if requested) stating either that the student is offered a position in a magnet school/ magnet program, or that the student is in a waiting pool for the requested program.
         
      3. If selected, Exceptional Education Students (ESE) students may receive a provisionary email (or letter if requested). The student’s seat will be held as the application is processed through the Exceptional Student Support Services (ESSS) Department to ensure program needs can be met at the requested school. The ESSS Department will recommend if a Student Study Team (SST) meeting is needed.
         
      4. Applicants offered a seat in a magnet school/magnet program are required to accept the seat by the designated date to be officially assigned to the magnet school/ magnet program. Failure to accept the seat will result in the student losing his/her seat.
         
      5. Any student currently attending Hamilton, Idyllwilde, Midway, Pine Crest, or Wicklow Elementary Schools and Millennium, Milwee, Sanford, or South Seminole Middle Schools as a zoned magnet student who moves out of that geographic attendance zone and into another District geographic attendance zone may complete the out of zone magnet application and remain in the magnet program as an out of zone magnet student.
         
      6. Pending class size availability and the accommodation of a student schedule, siblings will be permitted to attend the same school, as practicable.
    6. Magnet Schools/Magnet Programs Waiting Pool

      Students who are not offered a position in their first requested magnet school/magnet program are automatically entered into a waiting pool for that magnet school/magnet program. Waiting pools are organized according to the following criteria.
      1. On-time applicants not assigned to the magnet school or magnet program will be randomly placed in a waiting pool for that school for the remainder of the current school year.
         
      2. Magnet school/magnet program applicants who are not placed in their magnet school/magnet program, of choice during the current school year are required to resubmit their magnet school/magnet program application for the following school year.
         
      3. When positions become available, on-time waiting pool applicants will be offered positions prior to any late applicants, as practicable.
         
      4. Late applicants will be chosen from the waiting pool in order of the date and time their applications are received by the Student Assignment Department & Program Access.
    7. Transportation

      Transportation will be provided to all students enrolled in a magnet miles from the school/magnet program in which s/he is enrolled.

       
    8. Academic Criteria for Remaining in Secondary Magnet Schools/Magnet Programs
       
      1. Students admitted to the Millennium Middle School, Milwee Middle School, Sanford Middle School, and South Seminole Middle School SCPS Pre-IB Preparatory Programs are expected to maintain a 3.0 grade point average (GPA) for each nine (9) week grading period.
         
      2. Students admitted to the Academy of Health Careers and the International Baccalaureate Diploma Program at Seminole High School; the International Baccalaureate Diploma Program at Winter Springs High School; the Institute for Engineering at Lyman High School; and Crooms Academy of Information Technology are expected to maintain the following grade point averages (GPA).
        1. Academy of Health Careers 2.5 GPA
           
        2. International Baccalaureate Diploma Program 3.0 GPA
           
        3. Institute for Engineering 2.5 GPA (4) Crooms Academy of Information Technology 2.5 GPA
    9. New Magnet Schools/Magnet Programs

      The Superintendent shall be responsible for recommending to the Board for its approval new magnet schools and magnet programs. In making his/her recommendation, the Superintendent shall consider a number of factors including themes that would be attractive to diverse populations and sites that will support the goal of ensuring, consistent with Constitutional requirements, diverse enrollments at all schools.
  2. Virtual

    Virtual school provides flexible options to meet the demanding schedule of 21st century students. Students may enroll in District Virtual School (SCVS) full time. Virtual classes are available through ePathways (blending virtual with face-to-face courses) either at the zoned school during the school day in a virtual learning lab or outside of the school day.   3. Programs of Emphasis
     
    1. Program of emphasis provides a structured study strand centered on a career pathway. Students who are zoned for the school may select the program of emphasis, and a limited number of seats in selected programs are available for 9th grade students who are not zoned to the school. Not all programs of emphasis have available seats for out of zone students.
       
    2. Acceptance for out of zone students to a program of emphasis is by application only. By signing the required application, parents and students agree to the commitment statements and understandings. Assignment to this program is through the highest grade of the school. Students must be enrolled in and pass the program of emphasis courses to remain at the school unless there is a Board approved transfer that allows the student to remain at the school where the program of emphasis is located. In zone students who have a change in their attendance zone while enrolled in a program of emphasis and who are in good standing and continuously enrolled in the program course sequence, may remain in the program of emphasis with permission of the principal. No transportation is provided for a program of emphasis.
       
    3. Programs of emphasis that are open for out of zone applicants will be determined on an annual basis and published in January. Out of zone applications for programs of emphasis are limited to rising grade 9 students.
       
    4. If more applications are received than available seats for a program by the deadline, a random selection will be conducted. Applications submitted during the application period are of equal weight and not assigned on a first come, first served basis. Applications received after the application period will be placed in a wait pool by date received.
       
    5. Pending class size availability and the accommodation of a student schedule, siblings will be permitted to attend the same school to the extent practicable.
       
    6. Out of Zone Eligibility

      To be eligible for a program of emphasis, the student must:
      1. reside in Seminole County;
         
      2. successfully complete the 8th grade;
         
      3. meet specific program prerequisites and requirements; and
         
      4. sign the application indicating the parents and student agree to the statements and conditions listed for admission on the application.

Student Out-of-Zone Transfers

 

The Board strives to accommodate family choice to the maximum extent possible and offers incentives to relieve over-capacity schools, fill under-capacity schools, and to achieve diversity. The list of eligible transfer options is revised annually in January for the upcoming school year. The following transfers are, therefore, permitted subject to acceptable documentation:

  1. Annually Defined Options to Increase Choice
     
    1. Exceptional Student Education Transfers

      A student who is placed in an exceptional student education (ESE) program under IDEA shall attend the school at which the program serving the student is located, as long as the placement does not otherwise violate Federal or State special education requirements. Siblings of ESE students are allowed to attend school with their ESE siblings. Transportation is provided for ESE student transfers. Time Frame: One (1) academic year.

       
    2. Transfers are allowed for a student whose parents have begun actual construction on a home or who have a signed legal agreement for lease or purchase in the receiving school zone, if the student shall permanently move into the home by the end of the semester in which the transfer is to take place. Failure to move into the home or leased residence in the semester in which the transfer is requested (one (1) semester) shall result in cancellation of the transfer and return of the student to his/her zoned school. No transportation is provided for this option. Time Frame: One (1) semester. Required documentation for each of the pending move transfers is listed below:
      1. New Construction – contract signed by both parties indicating the address of property and the estimated move in date.
         
      2. Pre-Existing Purchase – contract signed by both parties indicating the address of the property and the estimated closing date.
         
      3. Lease – lease agreement signed by both parties indicating the address of the property, the term of the lease, and the effective date of the lease.
    3. Students who move to another school zone within Seminole County are permitted to complete the academic year at the school in which the students were legally enrolled prior to the change in address. No transportation is provided for this option. Time Frame: Remainder of the current academic year.
       
    4. Students who have legally completed the fourth, seventh, or eleventh grade at a given school and move to a different District zone are allowed to complete the fifth, eighth, or twelfth grade at the previously assigned school. Siblings may attend the school with the fifth, eighth, or twelfth grader for one (1) school year only. No transportation is provided for this option. Time Frame: One (1) academic year.
       
    5. Students who are placed in state shelter or foster care programs or who reside in private residential care programs shall enroll in the appropriate school, that serves the attendance zone in which the program is located, unless otherwise requested by the parent, foster care parent or other authorized person pursuant to Board policy applicable to homeless students or at the direction of the Superintendent.
       
    6. Granting of an exemption to Board approved student attendance zone assignment or a permitted inter-zone transfer is restricted to executive directors for elementary, middle, and high schools due to documented unique extenuating circumstances. To appeal a student attendance zone assignment or inter-zone transfer the parent of a minor student, or the student if over the age of eighteen (18), shall submit a letter to the appropriate level executive director detailing and documenting the extenuating circumstances for the appeal. Extenuating circumstances are defined as suffering from a documented physical, mental, or financial infirmity which, by ordinary and reasonable standards, justifies an exemption. Transportation is not generally provided for transfers under this option, but may be in extenuating circumstances, provided that the circumstances are equitable and nondiscriminatory. The Superintendent will present to the Board an annual report of all transfers granted under this provision. The findings and decisions of the executive director will be final. Time Frame: Executive Director Determination.
  2. Employee Transfers
     
    1. Students are allowed to attend the school at which a student’s parent is a full-time site based employee. Time Frame: Granted to highest grade of school contingent upon parent continuing employment and the limitations outlined in this policy. No transportation is provided for this option.
       
    2. Full-time status employees who are residents of Seminole County and not assigned to a school as a full-time, site-based employee may apply for a District offered employee transfer. The employee transfer is a voluntary option for full-time District employees that are residents of Seminole County to transfer their child to an under-capacity District school that is specifically designated by the Superintendent for this purpose. This transfer is contingent upon available capacity of the specifically designated schools. Time Frame: Granted to highest grade of school contingent upon parent continuing employment and the limitations outlined in this policy. No transportation is provided for this option.
       
    3. Full-time status employees who do not reside in Seminole County may apply for a District offered employee transfer. The employee transfer is a voluntary option for full-time District employees that reside outside of Seminole County to transfer their out-of-county child to an under-capacity District school that is specifically designated by the Superintendent for this purpose. This transfer is contingent upon available capacity of the specifically designated schools and continuing agreement with the out-of-county student’s Superintendent. Time Frame: Granted to highest grade of school contingent upon parent continuing employment and the limitations outlined in this policy. No transportation is provided for this option.
       
    4. Pending class size availability and the accommodation of a student schedule, siblings will be permitted to attend the same school to the extent practicable contingent upon parent continuing employment and the limitations outlined in this policy.
       
  3. Capacity Transfers
     
    1. The Superintendent will annually determine permitted student transfers between District elementary, middle, and high schools from an over-capacity school to an under-capacity school. An over-capacity school has an enrollment that exceeds its program capacity; an under-capacity school has an enrollment less than its program capacity. A list of the available capacity transfers will be determined and published annually by the Superintendent. Capacity transfers are granted to the highest grade of the school.
       
    2. If by April 1st of each school year the number of capacity transfer requests for the following year exceeds the maximum number permitted during any school year, a random selection process will be used to select approved capacity transfer students. No transportation will be provided for capacity transfers.
       
    3. Pending class size availability and the accommodation of a student schedule, siblings will be permitted to attend the same school to the extent practicable.
  4. Diversity Incentive Transfers
     
    1. The Board will provide transportation to the extent practicable and approve requests for Diversity Incentive Transfers that bring schools closer to the average percentage of students approved for free/reduced price meal benefits at the elementary, middle, and high school levels in accordance with the following criteria.
      1. Any student approved for free/reduced price meal benefits who attends a school with a high percentage of students approved for free/reduced meal benefits may transfer to a school with a low percentage of students approved for free/reduced meal benefits. Transportation will be provided to at least one qualifying school, to the extent practicable, for students who reside more than two (2) miles from the approved school.
         
      2. Any student who does not qualify for free/reduced meal benefits and attends a school with a low percentage of free/reduced meal benefits students may transfer to a school with a high percentage of free/reduced price lunch students, and transportation will be provided to the extent practicable to one qualifying school if the student resides more than two (2) miles from the approved school.
    2. The average percentage of students approved for free/reduced meal benefits shall be calculated separately for elementary, middle, and high schools, based on October FTE enrollment. Diversity incentive transfers are not permitted to or from schools with a balanced diversity percentage as measured by free/reduced meal benefits.
       
    3. The Superintendent will annually determine diversity incentive transfer options based on appropriate enrollment data. Diversity incentive transfers are approved to the highest grade of the school.
       
    4. Pending class size availability and the accommodation of a student schedule, siblings will be permitted to attend the same school to the extent practicable.
  5. Maximization Transfer
     
    1. A voluntary transfer option that is permitted by Board policy to encourage the transfer of students between designated under-capacity schools to designated greater under-capacity schools in order to make the most efficient use of available space and maximize family choice options.
       
    2. The Superintendent will annually determine permitted student transfers between District elementary, middle, and high schools from designated under-capacity schools to designated greater under-capacity schools. A list of the available maximization transfers will be determined and published annually by the Superintendent. Maximization transfers are granted to the highest grade of the school.
       
    3. If by April 1st of each school year the number of maximization transfer requests for the following year exceeds the maximum number permitted during any school year, a random selection process will be used to select approved maximization transfer students. No transportation will be provided for maximization transfers.
       
    4. Pending class size availability and the accommodation of a student schedule, siblings will be permitted to attend the same school to the extent practicable.
  6. John M. McKay Scholarship Program for Students with Disabilities

    The McKay Scholarship Program allows parents of students with disabilities who have an Individual Education Plan (IEP) or Section 504 Accommodation Plan, to choose another learning environment for their children. Parents may choose to enroll their child in a private school or, on a space available basis and in accordance with transfer options approved by the Board, a different public school in the District or in an adjoining county.   7. Opportunity Scholarship Transfers

    The Board will provide transfers as required by F.S. 1002.38. An eligible student may apply for an opportunity scholarship to attend the District.
    1. The Superintendent will determine the choice schools with the capacity to accept Opportunity Scholarship requests annually.
       
    2. Opportunity Scholarships are not granted to magnet schools or programs.
       
    3. Transportation is provided only as required by law.
  8. Student Transfer Time Frames
     
    1. Students that are approved for a transfer must register at the approved school by the stipulated date on the transfer form or the transfer is terminated.
       
    2. Once a transfer is approved and a student has enrolled in the transfer school, the student may not re-enroll in the zoned school or transfer to another school until the student has completed the academic year. In each subsequent year, midyear exits are not permitted.
       
    3. Students are permitted one (1) transfer per level (elementary, middle, and high school) from the same residential school zone.
       
    4. Annually defined options to increase choice, employee, and McKay Scholarship transfer requests are approved according to the time period indicated. Capacity, maximization, and diversity incentive transfers are effective through the highest grade level of the school and, once approved, do not require renewal, as long as the student remains a resident of the attendance zone from which the transfer was approved.
       
    5. Transfer requests should be submitted between February 1st and April 1st of each school year to be considered on time and to become effective on the first day of school for the following school year.<
